1. Validity of the conditions of sale
1.1. The terms of sale apply to purchases made from the e-summ.com online store by the buyer and the company Lptrade OÜ (hereinafter referred to as SUMM).
1.2. In addition to these terms, the legal relationships arising from the purchase of products from the e-summ.com online store are governed by the Obligations Act of the Republic of Estonia (hereinafter referred to as VÕS), the Consumer Protection Act (hereinafter referred to as TKS), and other applicable laws.
1.3. SUMM reserves the right to make changes to the terms of sale. Such changes will be reflected on the e-summ.com website.
1.4. The images of the products in the online store are illustrative and may differ from the actual products.
1.5. The descriptions of the products in the online store may contain unintentional errors. We recommend verifying product information on the manufacturers’ websites.
1.6. SUMM has the right to withdraw from the sales contract concluded through the online store without penalties and to withhold the ordered goods or services in the following cases:
– The goods are out of stock;
– The price or characteristics of the goods are incorrectly displayed in the online store due to a system error;
– The buyer does not meet the conditions set by e-summ.com.
If SUMM is unable to fulfill the order, SUMM will contact the buyer and refund the amount paid if the buyer has already made an advance payment for the goods.
2. Prices
2.1. All prices listed on e-summ.com include value-added tax (VAT).
2.2. The price will include shipping costs according to the delivery method chosen by the buyer.
2.3. Prices are valid from the time the order is placed until the payment deadline for the placed order expires (1 day after placing the order).
3. Placing an order
3.1. Add the desired items to your shopping cart.
3.2. To view the contents of your shopping cart, select “Cart” from the top right corner of the website.
3.3. To complete your order, choose your preferred delivery method.
3.4. After selecting the delivery method, fill in the required fields with your information.
3.5. After entering the data, choose your preferred payment method.
3.6 To confirm your order, tick the box next to “Yes, I agree to the terms and conditions” and then click “Continue.”
3.7. Orders placed on e-summ.com are processed on working days from Monday to Friday, 9:00 AM to 6:00 PM.
3.8 Minimum order quantity is 1.
4. Entry into force of the sales contract
4.1. By the sales contract, SUMM is obliged to deliver to the buyer the existing, manufactured, or future goods acquired by SUMM, and enable the transfer of ownership to the buyer. The buyer, in turn, is obliged to pay the amount indicated on the invoice for the goods and accept the goods.
4.2. The sales contract enters into force after the buyer’s payment is received in SUMM’s bank account.
5. Delivery to
5.1. After the sales contract enters into force, goods can be received in two ways:
5.1.1. The courier will deliver the goods to the address specified in the order;
5.1.2. The goods will be sent to the parcel machine specified in the order.
5.2. The delivery times indicated on the online store website apply from the moment the payment is received in the online store’s bank account.
5.3 To ensure prompt delivery, it is important to provide accurate and valid information when completing the order form with delivery details.
5.4. SUMM is not responsible for delays in delivery if the goods have been handed over to the logistics partners on time, but the delivery delay is due to circumstances beyond SUMM’s control or foresight.
6. Right of return
6.1. After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days. The 14-day return right only applies to private consumers. Legal entities are not granted the 14-day right of withdrawal.
6.2. The product can be inspected and its suitability verified, just as it would be in a retail store before purchase.
For example, you should not make coffee with a coffee machine or wash clothes with a washing machine.
6.3. The returned product must be complete (including the original packaging and all items included in the packaging, such as cables, etc.). If the product was purchased during a promotion where an additional item was added to the product, you must return the entire set (i.e., all products).
6.4. The buyer is responsible for any decrease in the value of the returned goods due to use that goes beyond what is necessary to determine the nature, characteristics, and functioning of the goods, similar to what is allowed in a retail store.
6.5. To return a product, you must submit a free-form withdrawal notice and send it to the email address [email protected] no later than 14 days after receiving the goods.
6.6. The buyer must return the goods within 14 days of submitting the withdrawal notice or provide proof that the goods were handed over to the logistics company within this period.
6.7. Upon receiving the withdrawal notice, SUMM will refund the buyer all payments received under the contract, including the delivery costs incurred by the buyer, without undue delay and no later than 14 days after receiving the withdrawal notice. However, SUMM is not obliged to refund additional costs if the buyer has explicitly chosen a delivery method different from the cheapest standard delivery method offered by SUMM.
6.8. All direct costs related to the return of the goods are borne by the buyer.
7. Force Majeure
7.1. SUMM is not responsible for any damages or delays in the delivery of goods if the damage or delay is caused by circumstances beyond SUMM’s control or foresight.
8. Processing of personal data
8.1. By entering data in the online store and confirming the corresponding agreement, the buyer grants SUMM the right to collect and process the buyer’s personal data (name, contact phone, delivery and/or home address, email address) and to transfer the personal data to logistics partners for the purpose of delivering the goods.
8.2. SUMM has the right to use the buyer’s contact details for advertising and other information purposes.
8.3. The buyer has the right to prohibit the collection and use of their personal data at any time, except when it is necessary for the collection of a claim arising from the contract or for the delivery of the goods.
8.4. Encrypted data communication with banks during payment ensures the security of the buyer’s personal bank credentials, and the online store does not have access to them.
9. Complaints procedure
9.1. SUMM is responsible for any non-conformity or defects in the goods sold to the buyer that become apparent within two years of the delivery of the goods to the buyer.
9.2. The buyer has the right to contact SUMM within one month of the defect being detected, providing the invoice that was used to pay for the goods. The notice of non-conformity must be sent to SUMM’s email address at [email protected]. If the buyer fails to notify SUMM of the non-conformity within the specified time frame, SUMM is released from liability for the non-conformity of the goods.
9.3. Upon discovering a defect, please discontinue the use of the product.
9.4. The repair or replacement of defective goods will be agreed upon between SUMM and the buyer.
9.5. SUMM is not responsible for defects caused by improper storage or use of the goods by the buyer.
9.6. In the event of non-conformity or defects in the goods, please send a complaint to the email address [email protected], including the name of the person who placed the order, contact phone, order number, and a detailed description of the non-conformity or defect.
9.7. Complaints regarding non-conformity or defects in the goods must be submitted within one month of discovering the non-conformity or defect.
9.8. All complaints will be reviewed, and the buyer will be contacted as soon as possible, but no later than 14 days after receiving the complaint.
9.9. The buyer has the right to demand a reduction in the purchase price or the termination of the contract and a refund of the purchase price if SUMM is unable to repair or replace the goods, or if the repair or replacement of the goods fails.
10. Buyer’s right to apply to the Consumer Complaints Committee
10.1. If SUMM has refused to resolve the buyer’s complaint or if the buyer is not satisfied with SUMM’s proposed solution and believes that their rights have been violated or their interests harmed, the buyer may file a complaint with the Consumer Complaints Committee through the Consumer Protection and Technical Regulatory Authority. The buyer may submit a complaint themselves or through a representative. Information about the Consumer Complaints Committee can be found on the Consumer Protection and Technical Regulatory Authority’s website. For issues arising within the European Union, the buyer can contact the European Consumer Centre.
